    Removal of BITS Material

    I just got off the phone with Earlene Hughes. We spoke for around ten minutes. I understand where she is coming from, and we parted on good terms. if you want the sessions from BITS, visit the BITS site. As of right now, there is nothing posted, but will be posted soon. With deep regret, I am removing the BITS sessions from the blog. I don’t really want to, but with respect to BITS and at the request of Earlene, I am doing so.

    In august, the Board is going to draft up a policy regarding recording BITS sessions. We’ll see what becomes of that.

    As of now, September 8, 2007, there has been no change in BITS policy in recording material.  I have checked on the site and saw recordings posted from this past year’s convention.  So be it.  I have not joined up with BITS and have not been asked to do so after my membership ran out.  Typical bullshit politics rule the roost over there.

    Inappropriate Posts of BITS Material

    I received a letter from Earlene Hughes, President of the Blind Information Technology Specialist affiliate of the American Council of the Blind. It is below.

    MSG 1:
    Will, you should have obtained our consent before you posted our BITS presentations at the ACB convention on your blog and podcast. These presentations are the property of BITS. It is one thing to record the presentations for your own personal use. It is quite another thing to distribute these presentations without the consent of BITS.
    BITS will be instituting a copyright policy to prohibit distribution of our material without our consent.

    My response:

    Earlene, you should have stated a policy regarding this. You know as well as I do that people have blogs and recording devices to use at there discretion. Maybe it would be in your best interest and the club’s best interest to say this. In no way was this communicated to me or anyone else. I love this lack of communication between officers and members of affiliates. I ask you how are they the property of BITS? Yes, you did spend money bringing in the people to make the presentations. Did ACB Radio get permission to air the presentations? How about the other guy who aired the BITS Assistive Technology showcase? Also, how do you copyright a presentation? You can’t exactly deem it under the rules of the DMCA.

    I honestly didn’t have time to think about the possibility that someone or a group of people would sit in the audience, make their own recordings, and distribute those recordings on the internet. Making a recording for your own personal use is not the same thing as distributing a recording to the general public.
    I realize now, that once Freedom Scientific took content from the ACB radio website and placed that content on their own website, BITS should have also instituted a similar policy. The podcasts and recordings were being done by Rob Hubbard at that time and the issue did not come up. No one had recorded any of the BITS convention presentations and placed their recordings on their blogs or websites until now.

    I agree, and I will be talking to the BITS board about the matter.

    We cannot read minds or anticipate every situation that can arise. There was no lack of communication intended here. If anything, it was you, who did not communicate. You recorded our meetings, (yes, I know you too are a bits member) but, as a courtesy, at the least, you could have told us you planned on recording the sessions and placing them on your website. You did not ask or let us know you were doing this.

    The presentations were under the jurisdiction of BITS and ACB as part of the ACB convention. You have acknowledged that we brought people in.

    ACB radio aired the presentations in conjunction with BITS, as part of the ACB convention.

    I have also expressed my displeasure to the other person.

    BITS will be instituting a policy to address the matter and how to handle recordings of our BITS sessions at conventions.

    As BITS President, I respectfully ask you to remove your recordings of our BITS session from your blog, podcast, and website until the matter can be resolved.
    Two of our board members are on the ACB cruise and I cannot have a discussion with the BITS board until they return.

    I will remove the post the public couldn’t attend, the BITS Luncheon. The public had access to the other events I posted. The events were open to the public, which means anyone could have walked in and took a seat and witnessed what went on. The point was for those who couldn’t attend the convention, they got to hear the Battle of the GPS Systems. I know a lot of people wanted to hear that one.

    It’s a shame an ACB affiliate has to be nit picky like this. I did offer to assist with recordings of the events. My offer wasn’t accepted, so I thought I would give my perspecttive of the events attended.

    Simple Gifts

    I play in a church band known as Simple Gifts at Saint Bartholomew’s in North Augusta. Here is a recording I made of me playing in the band. I am the one playing the drums. These are songs that didn’t require a lot of fancy rolls and other things I like to do. I was mainly testing out the recorder to see if it could handle this type of recording. You also get to hear me taking communion. Go ahead and grab this one.
